    Community Planners say No De-Facto Ban - Let the communities decide!

    Community groups seek input on pot dispensiaries

    The location of medical marijuana dispensaries should be left up to individual communities rather than have to follow blanket rules set out by the San Diego City Council, according to the city’s community planning groups.

    At their monthly meeting Tuesday, the groups, comprised of citizens from across the city, voted to make an official recommendation to the council to allow community groups to decide restrictions for medical marijuana shops in their areas.

    The City Council is mulling a plan that would allow dispensaries in select industrial and commercial zones that have no residential uses. They would also have to be at least 1,000 feet from other dispensaries, parks, youth centers, religious institutions, day care centers and schools.

    Americans for Safe Access San Diego chapter coordinator Eugene Davidovich said the city is placing a de facto ban on dispensaries due to the stringent nature of the restrictions.

    “It doesn’t allow for facilities near patients,” Davidovich said. “Folks who need their medicine to function would have to find other ways to get their medicine and could go to the black market.”

    If the current rules were approved, areas such as Ocean Beach, La Jolla and Hillcrest would be completely zoned out, despite their planning group representatives saying they are open to having strictly regulated dispensaries in their neighborhoods.

    Joe LaCava, the president of the La Jolla Planning Association, said there are already about a half dozen dispensaries in his neighborhood, and they have been good neighbors.

    The City Council does not have plans to bring up the issue of zoning medical marijuana shops before the new council is in place in December.

    Patient Advocates Launch Effort to Oppose Steve Cooley as California Attorney General

    Oakland, CA -- The medical marijuana patient advocacy group Americans for Safe Access (ASA) stepped up its campaign this week to oppose Steve Cooley in his bid for California Attorney General. Hoping to convince Californians against voting for Cooley, ASA has launched the website www.NotCooley.com to highlight the ways in which Cooley would be bad, not only for patients and their providers but also for those who are concerned about the environment, equal rights, and criminal justice issues.

    "The Attorney General's race is, without a doubt, the most important race for medical marijuana patients in California," said ASA Executive Director Steph Sherer. "Cooley already has the motivation, but we must not give him the means to broaden his attack on patients." Cooley has long fought patient advocates on the issue of medical marijuana. As Los Angeles District Attorney, Cooley condoned dozens of SWAT-style raids on local dispensaries, aggressively prosecuted patients and their providers, and tried to criminalize the "sale" of medical marijuana. Advocates fear that Cooley will try to expand his agenda to the entire state. "As Attorney General, Cooley could dismantle many of the gains made by patients over the past 14 years," said Sherer.

    Notably, the effort to defeat Cooley on November 2nd has appealed not just to medical marijuana patients, but also to criminal justice, environmental, and marriage equality advocates alike. Opponents argue that Cooley's stance on a variety of issues makes him "Not Cool" for California. From his fervent support for the death penalty and Proposition 8, to his weak record on environmental justice and enforcement, Cooley has alienated much of the voter base he needs to get elected. "California's top law enforcement officer must protect the sick, the disenfranchised, and those targeted for discrimination," continued Sherer, "and, Steve Cooley fails on all counts."

    The race for California Attorney General is closely contested, with Cooley's challenger, San Francisco District Attorney Kamala Harris, gaining in the polls. Unlike Cooley, Harris has shown consistent support for the state's medical marijuana laws and those fighting for marriage equality. On the issue of whether local medical marijuana distribution, or dispensaries, are legal under state law, the two candidates could not be more divergent. While Harris has recognized the need for dispensaries and has supported statewide regulations, Cooley by contrast has sided with the California Narcotic Officers Association (CNOA) approach that dispensaries must be "eradicated."

    According to the Sacramento Bee, the race for California Attorney General is getting even more heated. The Virginia-based Republican State Leadership Committee (RSLC), a corporate front group funded by tobacco, insurance and gambling interests, and coordinated by Karl Rove, is spending $1 million in last-minute TV attack ads against Harris. On the other hand, President Obama has strongly supported and raised funds for Harris, who is the single African-American Democrat on the statewide ballot. Harris is also California's first African-American District Attorney and, if she wins next week, would be the state's first female Attorney General.

    James Stacy, from Life in Prison to No Jail Time; Plea Deal Reached in Federal Medical Marijuana Case

    Over ninety jurors were screened and made available for two weeks, all motions filed by both sides, and today in a surprising turn of events, less than a week before trial was to begin a resolution was reached between the US Attorney’s office and the defense in the James Stacy Federal medical marijuana case.

    On Monday of this week, the US Attorney’s office made another plea bargain offer to Stacy.

    After internal meetings and conferences the US Attorney made the following offer to Stacy; no jail time, drop all charges except one count of manufacturing marijuana, and three years probation.

    After consulting with his family and defense attorney’s Stacy decided to sign the deal.

    Today at 11am Stacy was due in court for his last motion hearing before trial, instead of hearing arguments about pre trial motions, the details of the plea agreement were discussed. In front of a courtroom filled with Americans for Safe Access Members and James Stacy supporters, Judge Moskowitz accepted the agreement and set a sentencing date for January 7 at 10:15am.

    Stacy was raided on September 9, 2009 the same day over a dozen other medical marijuana dispensaries were raided in San Diego County as part of District Attorney (DA) Bonnie Dumanis’ fierce fight against medical marijuana patients, dubbed by her office as “Operation Green Rx”.

    The reason for his case going to federal court where he had no defense versus state where he would have been found in clear and unambiguous compliance with state law, still remains a mystery, and is a question the U.S. Attorney prosecuting Stacy has refused to answer.

    After this turn of events in the Stacy case, it seems that the US Attorney’s office finally realized that if they were to take this case to trial, a conviction would be very difficult to achieve and the public outrage at the waste of resources on such a prosecution would create a public relations nightmare for the office.

    Advocates are hopeful that now Dumanis will think twice before sending another dispensary that is in full compliance with state law to federal court in San Diego.

    The trial is scheduled to begin at 9am - November 1, 2010 in Courtroom 15 at the Federal Courthouse located on 940 Front St. San Diego CA 92101, and is expected to last for approximately two weeks.

    NUG Travel Writer In Custody with No Bail - Write Scotty in Jail

    Another member of NUG Magazine has had problems with our local law enforcement. Our travel writer Brian "Scotty B." Whytsell ends up in jail with no bail.
    While in the Vons parking lot in Carlsbad, law enforcement contacted Scotty and a friend of his.

    The officer asked if either were on probation or parole. Scotty was, as a result of a marijuana conviction in 2009.

    Despite Scotty possessing a physician’s medical cannabis recommendation, the cops searched his parked car based on his Fourth Amendment waiver, found his medicine, and arrested Scotty. The cops in Scotty’s car a half pound of different strains of cannabis and twelve clones, all of which is half the amount his recommendation allows him to posess.

    Initially his bail was set at $50,000 which he posted, but when Scotty went to his court hearing the following week, the Judge bucketed him on a “probation hold” from a previous cannabis conviction and Scotty has been in custody going on 2 months now.
    Well over 2/3’s of NUG writers have been arrested by local police for our medicine.

    ASA Advocates Take Possession of Marijuana Plants from San Diego County Sheriff

    District Attorney Bonnie Dumanis and her ‘fierce fight’ against medical marijuana patients suffered another devastating defeat this week. Advocates from the local chapter of Americans for Safe Access (SDASA), the nation’s largest advocacy group promoting safe and legal access to cannabis for therapeutic use and research, successfully obtained an order from the courts for the release of five large impounded medical cannabis plants. The judge ordered the plants released to a representative of SDASA for their safe keeping.

    On Wednesday afternoon of this week, Marcus Boyd of SDASA retrieved the plants from San Diego County Sheriff’s evidence locker.

    The patient, to who the plants belong, remains in custody for cultivating them despite all the charges in his case being dropped, and will receive his plants upon release.

    On September 2, John Palmer, a resident of Imperial Beach was arrested by Detective Michael Thomas Neumann and other members of the San Diego Sheriff's Department during a ‘routine’ probation search. Following the search and the discovery of the plants, Palmer was charged with possession, possession for sale, and cultivation of marijuana.

    At the time of the search Palmer was in full compliance with state law, in fact, deputies found Palmer's state issued Medical Marijuana Identification Card as well as another patients' doctor's recommendation posted on the wall next to the grow.

    During the search, Palmer explained to deputies that he was lawfully and collectively growing the medicine, as approved by the Probation Department. He explained that three weeks earlier he was granted a court order from a judge specifically allowing him to grow marijuana while on probation.

    Detective Neumann not being aware of the law, called the infamous local medical marijuana eradicator and ‘expert’ cultivator, Detective Steve Reed, to find out if Palmer could be charged with cultivation and possession for sale. Detective Reed said, “medical pot? Ha! Book-em and charge-em!"

    Deputies arrested Palmer, impounded the plants and incarcerated him in the Vista jail where he remains today and is scheduled to be released on Monday October 25, 2010.

    The other patient who was collectively cultivating the plants with Palmer and whose collective grow was confiscated during Palmer's arrest was not arrested himself. After learning of Palmer's arrest he was able to quickly make contact with Marcus Boyd of SDASA in search of assistance.

    Boyd, who hosts the monthly South Bay meeting for SDASA in Imperial Beach, immediately contacted Salina Epley, Palmer’s public defender in the case, began providing assistance with the case as well as attending Palmer’ court hearings along with SDASA Advisory Board Member Terrie Best.

    During the court process, the prosecutor was insistent upon keeping Palmer in custody, despite being told by the Judge that Palmer would likely be found not guilty if the case went to trial. The Judge urged that a plea bargain be worked out.

    All plea offers from the prosecutor were unreasonable and therefore unacceptable to Palmer. A plea deal was not reached and a trial date was set for November 10th.

    On October 6th, Palmer was back in court for an evidentiary / readiness hearing. That day, after reviewing the motions filed by the public defender, the prosecutor moved to drop all marijuana related charges against Mr. Palmer.

    At a prior hearing however, the judge ruled that the prosecutor had provided sufficient evidence to violate Palmer's probation status remanding him into custody for another 20 days.

    In light of the extended jail time, the public defender conferred with her client and while officially on the record, recognized Americans for Safe Access's support in the case and formally requested the court, "immediately release the five mature plants to Americans for Safe Access's representative, Marcus Boyd, for safe keeping".

    Surprisingly, the prosecutor did not argue, stipulated to the request, and the court did not hesitate in granting the motion.

    John Palmer left the courtroom in good spirits and was very happy to have won his case. He yelled "thank you" while deputies escorted him out of court.

    Yesterday morning with the court order in hand, Marcus Boyd and Eugene Davidovich of SDASA, went to the San Diego County Sheriff’s evidence room and picked up the plants with no delay or resistance from Detective Neumann or any other law enforcement officials.

    In fact when Boyd called Detective Neumann and asked him to fax over a release of the property form to the evidence locker, Neumann replied “I don't have a problem with it and I won't stand in the way. I'll send them whatever they need this morning”.

    When Boyd and Davidovich arrived to retrieve the property, it was found that all the plants had been clipped at the stem right above the roots. In fact the day they were confiscated, Detective Neuman, instead of transporting them and taking care of the property as required by procedure, simply cut them and stuffed them in a large paper bag, ensuring that they could not be usable when and if they were ever retrieved.

    The plants were immediately rushed to Kim Twolan, the founder of Mother Earth Co-op located in Mission Hills. Twolan, who is also a SDASA Advisory Board member and serves on San Diego City's Medical Marijuana Task Force after thorough examination and several attempts to revive the plants, pronounced them dead upon arrival.

    Palmer intends to file a claim for the damaged property upon being released from custody on Monday.

    SDASA member and local criminal defense attorney Melissa Bobrow has agreed to help Palmer with the property damage claim against the county.

    San Diego County Narcotics Task Force Detectives Open and Operate Medical Marijuana Dispensary in San Diego

    The undercover officers dubbed themselves as ‘New Management’ before detaining and interrogating unsuspecting patients walking into the dispensary that day.

    SAN DIEGO –Thursday morning of last week, San Diego County Narcotics Task Force (NTF) detectives arrested James Harder a founding member of the Helping Hands Wellness Collective at his home in San Diego. The detectives also served search warrants at the dispensary located on 5th Avenue in Hillcrest. The arrest and search of the dispensary was the extent of what the search and arrest warrants authorized the NTF to do that that day.

    After booking Harder into San Diego County Jail, NTF Detective Mark Andrew Carlson however was not finished. He ordered his team to dawn orange Helping Hands Wellness shirts and open the dispensary on time at 10am, taking San Diego District Attorney (DA) Bonnie Dumanis’ fierce fight against medical marijuana to a whole new level.

    Mark Carlson is the same detective who for over two years, under the direct orders of Deputy DA Chris Lindbergh led the investigation and helped prosecute Jovan Jackson of Answerdam collective. After Jackson was vindicated of all marijuana related charges in his first trial, Carlson was instrumental in convincing the DA’s office to continue with the second prosecution and trial.

    According to Matt, one of the patients who visited the dispensary that day, detectives welcomed him to the collective, told him the facility was under ‘new management’, checked him in, and even provided him with free concentrated cannabis (hash) as a gift before inquiring with the unsuspecting patient whether he cultivated his own medicine. As soon as Matt told them that he did, the detectives pulled out their badges, said they were DEA, and then proceeded to detain and interrogate him for almost two hours.

    San Diego Americans for Safe Access (SDASA), the local chapter of the nation’s largest advocacy group advancing therapeutic use and research medical marijuana, received a call on Thursday around noon from another patient who said the Helping Hands Collective was “taken over” by law enforcement. The call was followed by an email to SDASA from a sales representative of San Diego CityBeat, who also stopped into the dispensary that day to visit their advertising client only to find out that the place is ‘under new management’.

    Upon receipt of these reports, SDASA quickly activated the local Raid Response Team (RRT). The team was successfully able to verify, confirm, and notify the community of the raid within minutes of the initial reports.

    San Diego CityBeat reported on the story that afternoon, quoting Matt as saying, “They kept asking how much medicine do I buy, how am I affording it, where am I getting it from, what cooperatives I’m a member of where my garden is, they just basically, in a easy sentence, they raped me for everything I had and never told me I had a right to remain silent. They made me think if I didn’t talk they would arrest me on the spot.”

    The NTF detectives were operating the collective from 10am to 2pm before being forced to cease their activity by San Diego Americans for Safe Access advocates, who quickly arrived on the scene.

    Aside from the quick response, members of SDASA’s RRT that day, successfully and lawfully intervened and were able to stop to the NTF from operating the collective and putting additional patients at risk of this rogue action by San Diego NTF detectives.

    San Diego Americans for Safe Access – Raid Response Team Eye Witness Account:

    After receiving the call from a patient on Thursday morning, I first called Helping Hands to verify the reports of a ‘take over’. A male voice in a very polite manner answered the phone saying “Helping Hands, how may I help you today?”

    I asked the male, “Is the collective open today?”

    My question was quickly answered with another question. “Are you a customer or a vendor?”

    This immediately raised a red flag for me and added to my suspicion that the person on the other line, was not a member of the collective but was in fact an undercover police officer posing as a member. I asked myself, “has the NTF actually stooped to this level?”

    I proceeded to tell the person on the line, “My name is Eugene Davidovich and I’m calling from San Diego Americans for Safe Access, can we speak to a member of this collective?”

    The male answered, “Hold on let me let you speak with the manager.”

    After a short delay, another male got on the phone, and this time said “Who is this, can I help you?”

    The voice was very familiar and only one name came to mind; Detective Mark Andrew Carlson, San Diego NTF detective who was the lead investigator in the Jovan Jackson case.

    I introduced myself to the supposed “patient” and asked to speak to a member of the collective again. This time the undercover told me “hold on” and the line went dead.

    Following this conversation, I activated the SDASA RRT and headed for the facility in Hillcrest.

    Before I arrived at the collective, Terrie Best, another member of the RRT was already on the scene conducting an onsite survey. By the time I arrived, Terrie reported finding no evidence of police activity in front of the collective and at first, everything appeared to be normal. No police cars, DEA trucks or any other law enforcement activity was visible. The facility appeared open, and we could see people moving inside through the windows.

    As soon as Terrie and I walked up to the front entrance of the facility, the lock in the glass tinted doors clicked shut. I knocked on the door and through the tinted window could see someone wearing an orange Helping Hands T-Shirt motioning to us with a finger that he would be right with us.

    After not being let in through the fount doors, we walked around the back of the building into the alley.

    This is when we realized the reports were true. The NTF had taken over the collective and was operating it under the guise of “new management”.

    Six large F150 trucks were parked in the alley in back of the facility. A large white trailer was pushed up to the back door of the collective and almost a dozen undercover officers were scurrying back and forth loading unmarked boxes and bags in to the trailer.

    After several minutes of watching the officers pack the trailer, I saw Detective Carlson walk out from the back of the collective. The minute he saw me, he screamed “Eugene, get out of here”.

    While Carlson was busy venting his anger out at me, Terrie was busy questioning the other detectives as to why they were there, what agency they were with, etc.

    I could hear Terrie ask one of the undercover officers, “are you San Diego County Sheriff or DEA”?

    The undercover replied, “I’m a Sheriff from one of 58 Sheriff’s Department in the State”.

    “Which one”? Terrie asked.

    After hesitating for a moment the detective finally caved in and admitted, “I am with the Santa Barbara County Sheriff’s Department”.

    “Why did you raid this collective?” Terrie continued.

    The undercover replied, “That’s a part of an ongoing investigation, and I can’t talk about it unless you are with the media, are you with the media?”

    “No I am not”, Terrie replied. “But what would you tell me if I was with the media?”

    The detective could not resist Terrie’s friendly demeanor and sweet personality he told Terrie “I would tell you to call the Public Information Officer”.

    “Great, what’s his name and number”, Terrie replied.

    “That’s not Public information” the officer hissed.

    Terrie was quick to point out that “you just told me that it was the ‘Public’ information officer was it not?”

    The detective frustrated, let out a groan and walked away. Clearly perturbed with the SDASA RRT presence, Carlson proceeded to hurry all the detectives along to pack the trailer faster.

    By this time Dennis and Melissa, two other members of the SDASA RRT arrived on the scene and joined our efforts.

    As we continued to monitor the situation, one of the officers dressed in an orange Helping Hands t-shirt walked out of the collective and began to chit chat with the others, apparently forgetting that he was still dressed up as a ‘member’ of the collective.

    I walked closer to him and called out “Excuse me sir, with the Helping Hands shirt, are you a member of this collective?”

    The detective at first ignored me, then quickly two others ran up to him, and began to shout at the undercover, “I told you to stay inside, you are under arrest”.

    When I realized, the detectives were trying to create the appearance that the person wearing the Helping Hands shirt, was actually a member under arrest and not an undercover officer, I couldn’t help but laugh at the pathetic attempt. Minutes later, a photographer from NBC arrived to document the events.

    After seeing news cameras, detectives jumped in their cars and took off with tires screeching ending their day of opening and operating a dispensary.

    Following this incident, I contacted Detective Carlson’s boss with the San Diego Police Department and inquired if Carlson was authorized as part of the investigation to operate the dispensary. His boss told me that he was not aware that the NTF was actually operating the facility. He said he was under the impression that San Diego detectives were simply assisting the Santa Barbara NTF in executing a search and arrest warrant.

    James Stacy Prosecution Continues; Federal Trial to start in November

    SAN DIEGO – In March of 2009, the current administration announced “they would not prosecute medical marijuana patients and providers whose actions are consistent with state medical marijuana laws.” At least that’s what the California Legislative Analyst told Californians in the voters guide for the November 2010 elections. (1)

    Approximately six month after the Presidential announcement in October of 2009, the Department of Justice (DOJ) issued a memo urging all federal prosecutors and other agencies to “not focus federal resources in States on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana”. (2)

    A month prior to the October 2009 DOJ memo and only ten weeks after opening, James Stacy was charged in federal court following a raid on the Movement in Action dispensing collective in Vista, CA, making him the first medical marijuana provider to be tried under the new federal policy.

    The dispensary was raided on 9/9/9 the same day over a dozen other medical marijuana dispensaries were raided in San Diego County as part of District Attorney (DA) Bonnie Dumanis’ fierce fight against medical marijuana patients, dubbed by her office as “Operation Green Rx”.

    A few weeks prior to the raid, an undercover detective armed with a legitimate medical marijuana recommendation and a valid California ID came into the collective, presented all the appropriate paperwork, completed the membership agreements, and was allowed to join.

    The detective posing as a legitimate patient was distributed a small amount of medicine and prior to leaving asked Stacy if he could contribute to the effort with labor and not just financially. According to police reports, Stacy welcomed the offer and told the undercover specifically what he could do around the facility that did not involve a financial contribution.

    Stacy is the only defendant from the September raids who was charged in federal court, has refused all deals, and has taken his case to trial. The reason for his case going to federal court where he has no defense versus state where he would have been found in clear and unambiguous compliance with state law, still remains a mystery, and is a question the U.S. Attorney prosecuting Stacy has refused to answer.

    In a recent article on change.org, Kris Hermes of Americans for Safe Access (ASA), the nation’s largest medical marijuana advocacy group wrote, “In many ways, James Stacy is no different than hundreds of other dispensary operators in California. In fact, most federal defendants take plea bargains and never go to trial, mainly because they know they will have no defense against their charges. Truth has been taken out of federal trials to appease government prosecutors and the DEA in their effort to undermine state medical marijuana laws.” (3)

    Much like other federal cases, in Stacy’s case, U.S. District Court Judge Barry Ted Moskowitz precluded him from presenting any evidence of medical marijuana in the trial (5), including barring the defense from talking about the Presidential announcement of March 2009, the DOJ memo issued in October of 2009 as well as the fact that Movement in Action was a medical marijuana dispensary operating in full compliance with state law.

    Judge Moskowitz ruled that any reasonable man or woman having read or heard the memo and announcement would NOT have interpreted them to mean that the Federal government was changing their policy with regards to medical marijuana prosecutions. It would appear that under this ruling, the California Legislative Analyst as well as the hundreds of thousands of citizens who understood the announcements to mean "they would not prosecute medical marijuana patients and providers whose actions are consistent with state medical marijuana laws", are not reasonable.

    Since the ordeal began in September of 2009 Stacy’s case has garnered national attention and outrage from thousands of patients across the state who believed the administration’s announcements and thought the Federal intervention in State’s medical marijuana laws was over.

    Stacy himself has become an outspoken advocate of patient’s rights and HR 3939 the “Truth in Trials Act”, which if passed by Congress would allow federal defendants to present “evidence during trial that the activities they were engaged in were performed in compliance with their state’s duly-enacted medical marijuana laws.” (6)

    In response to Stacy’s activism, and refusal to accept a deal, the U.S. Attorney’s throughout the last year filed three indictments against Mr. Stacy turning the original counts into eight trumped up charges.

    The latest charges include ‘distribution of a controlled substance to someone under twenty one’. The prosecution claims they found two patients in the dispensary records that were ‘underage’. One of the patients was nineteen and the other twenty years old at the time of their membership.

    The other charge in the most recent indictment was one not heard of before in these types of cases, a charge for being an ‘Illegal drug user’. The prosecution claims that since Stacy admitted to being a medical marijuana patient and because there is no allowed medical use of marijuana under federal law, that he was an ‘Illegal’ drug user.

    After the most recent superseding indictment, the defense filed several motions asking the court to dismiss the trumped up charges as well as to address the vindictiveness of the prosecution against Stacy.

    On Wednesday of last week, Stacy was back in court, where Judge Moskowitz heard oral arguments regarding the motions filed by the defense. Kasha Castillo, Stacy’s Federal Public Defender argued that there was no clear definition in the law about what constitutes a ‘legal’ versus an ‘Illegal’ user, making this statute unconstitutionally vague.

    The U.S. Attorney fired back stating that marijuana was not a medicine and had no accepted medical use, making Stacy an illegal drug user.

    There were no oral arguments heard about the underage or vindictive prosecution charges as both attorneys agreed to submit those arguments in writing. Judge Moskowitz declined to rule on the motions that day and said he would issue a written decision within the week.

    The next court date in Stacy’s case is set for October 20th at 10:30am in Courtroom 15, where motions in limine will be heard. The trial set to start on November 1, 2010

    Aside from not taking a deal and advocating for HR 3939, Stacy has successfully organized and put on a medical marijuana convention in San Diego, with the second one dubbed Rx Fest II (7), planned for October 24 from 4:20pm – 9:30pm at the Maritime Museum on board the Berkeley Ferry Boat. That day hundreds of medical marijuana patients and concerned citizens will come together to help raise money for James Stacy as he goes through the Federal trial.

    Dispensaries Raided on 10/6 - Two San Diego Locations Targeted

    Update on Five Medical Marijuana Dispensaries Raided October 6, 2010

    The news coverage that came out about the raids, first quoted the Narcotics officers as saying there was allegations of non cannabis drugs being sold from the dispensaries. Now, the story has changed….there is no mention of other drugs, and the cops are claiming the dispensaries were making a profit. The story keeps changing…..this sounds like another Operation Green Rx investigation where initially the authorities claimed that there was other drugs and profit involved, however as the story unfolded, it was found there was no other drugs, no profit, and only full compliance with state law. The community is keeping a close watch on these raids and investigations.

    Raided medical marijuana dispensaries targeted due to alleged profits

    A group of five medical marijuana dispensaries, including one in Covina, raided by authorities Wednesday were targeted because the operators were allegedly turning a profit from the establishments in violation of state medical marijuana laws.

    Eleven people were arrested in connection with the operation, which took place Wednesday morning in Los Angeles, Orange, Riverside and San Diego counties.

    The Alternative Medicine Collective of Covina, 20050 E. Arrow Highway, Suite B, was forced to close its doors after a multi-agency task force seized its products, along with four other dispensaries in the four-county operation, Los Angeles County sheriff's officials said. No one at the Covina dispensary was arrested.

    Under California's Proposition 215, also known as the Compassionate Use Act of 1996, medical marijuana dispensaries are only allowed to operate as non-profits, Capt. Ralph Ornelas of the Sheriff's Narcotics Bureau said.

    "This organization was definitely working outside the law," he said.

    "Our investigation proved they were charging people and making a profit out of it," Ornelas said. "You're not supposed to make a profit."

    Authorities also searched an Alhambra home in the 1600 block of Curtis Avenue, though no evidence was seized, the captain said.

    Erik Andresen, 35, of Seal Beach was arrested as the "primary suspect" in the case against the five dispensaries, Ornelas said.

    He was booked on suspicion of cultivation of marijuana and another marijuana-related offense at the sheriff's Norwalk Station, according to a jailer. He was released Thursday after posting $100,000 bail.

    Andresen said he serves as an advisor for the organization of patients involved and denied any wrongdoing.

    "We are a group of patients who are together, collectively, to provide medicine for sick people," he said.

    Andresen said the dispensaries did not make a profit.

    "You're allowed to be reimbursed for your time," he said. He declined to say how much money he has received in compensation, but described it as "piddly."

    "I don't own a home," he said.

    Andresen added that the collectives generally give excess marijuana free of charge to their sickest patients.

    "We don't turn a profit because be give away any extra proceeds," he said.

    The names of the other 10 people arrested on drug related charges were not available Thursday, Ornelas said.

    In all, the multi-agency task force searched five marijuana dispensaries, one cultivation site, two processing sites, seven homes and a sailboat, sheriff's officials said in a written statement.

    Ornelas said they were located in Covina, Alhambra, Long Beach, Seal Beach, Huntington Beach, Fullerton, Los Angeles, San Diego, Riverside and Palm Springs, Ornelas said.

    In addition to the Covina establishment, the medical marijuana dispensaries raided Wednesday included the Palm Springs Holistic Collective, the Riverside Compassionate Wellness Center, the San Diego Holistic Collective, and the Compassionate Medical Collective in San Diego, Ornelas said.

    Andresen said that as far as he knows, only one dispensary in San Diego is affiliated with his patient group.

    Officials seized 35 marijuana plants, valued at $70,000; 78 pounds of processed pot, valued at $234,000; seven gallons of concentrated cannabis oils, valued at $44,800; about 4,000 pre-packaged, marijuana-laced edible products; hydroponic growing equipment and chemicals; and about $20,000 in cash, according to the sheriff's statement.

    The edible products included, "Lolly pops, ice pops, candy bars, brownies - all that stuff," Ornelas said.

    He said sheriff's narcotics officials are looking into requesting agencies such as the Food and Drug Administration get involved.

    Andresen said he would have no problem cooperating with health regulations governing edible marijuana products.
