Judge Cancels Oral Arguments in Case involving Briana Bilbray, Dispensaries Seeking Injunction to Stop Federal Crackdown

SAN DIEGO – In October of last year several U.S. Attorneys from the Department of Justice (DOJ) held a press conference in Sacramento announcing a new Federal crackdown on medical marijuana patients and providers across California.

Days after the announcement, hundreds of letters from the DOJ were sent to landlords renting commercial spaces to dispensaries threatening criminal prosecution and property forfeiture, unless their dispensary tenants were immediately evicted. Similar letters were sent to patients threatening federal criminal indictments.

In San Diego, the attacks involved both the DOJ and local officials. Jan Goldsmith, the San Diego City Attorney with support from City Council also wrote landlords and patients, making similar threats. In addition, his office filed almost one hundred lawsuits against the facilities claiming they were in violation of local zoning ordinances.

The letters were followed by several swat-style raids on a handful of dispensaries that remained open. In less then five months the attack from both Federal and local officials, the lawsuits, and raids, caused over 150 legitimate, tax paying, businesses, to shutter their doors in San Diego alone.

The community however, did not remain quiet. Massive outcries and opposition came from patients and advocates across the state. Protests were quickly organized, new legislative efforts started, and lawsuits filed against the DOJ in every district of the State.

Once such lawsuit jointly filed by patients and collectives in San Diego, involves republican Congressman Brian Bilbray’s daughter, Brianna Bilbray. A cancer survivor and medical marijuana patient herself Ms. Bilbray, joined the suit in November.

“My cancer has a 40 percent chance of reoccurrence and I'm really nervous I'm not going to be able to get it [marijuana] cause, the nausea's just unbearable." Ms. Bilbray was quoted as saying in an article by the Imperial Beach Patch.

In an attempt to stop the issue from being heard by the courts, the DOJ filed a motion demanding the case be thrown out. Oral arguments for the ‘motion to dismiss’ were scheduled to be heard this Friday, March 3, in Judge Sabraw’s courtroom.

Days before the hearing, on Wednesday, attorney’s representing the patients in the case learned the hearing was cancelled.

"Judge Sabraw has decided again to cancel oral arguments and decide the Government's ‘Motion to Dismiss’ based solely on the pleadings. Accordingly, there will be no court appearance on Friday. In the event the Court grants the Government's motion, this case will be ripe for appeal to the Ninth Circuit Court of Appeals which is what we intend to do." Dumanis Stoops To New Low Conducts Surveillance of Patients - Benjamin Gasper Trial Update


In line with San Diego District Attorney Bonnie Dumanis’ self proclaimed ‘fierce fight’ against medical marijuana patients in San Diego, almost two years after his initial arrest, the second attempt to prosecute Benjamin Gasper, a legal medical marijuana patient is underway. Dumanis’ office days before trial was supposed to begin, brought in ‘new’ evidence in an attempt to pressure the defendant into taking a deal rather then going through with the trial. The ‘new’ evidence includes transcripts of text messages between Benjamin, other medical marijuana patients, his family, and friends. 

Benjamin Gasper's trail has been postponed to allow the defense to respond to the new evidence. The next court date is March 19th at 9:30 in department 50 of San Diego Superior Court.

“The latest move from the prosecution makes it clear that Dumanis is willing to go to great lengths to persecute patients, including surveying their text messages, emails, and personal communications. San Diegans Protests Federal and Local Assault on Medical Marijuana Patients Rights

SAN DIEGO – On Thursday February 16th at noon, activists, patient advocates, and concerned citizens from all walks of life converged on federal courthouses in states and cities across the nation in a coordinated effort to voice their opposition to the continued federal and local assault against medical marijuana patients' rights.

The protest, part of Medical Cannabis Week; a week of action called by Americans for Safe Access (ASA), the nation's largest medical marijuana patients' rights advocacy group, to draw attention to “Obama's failure at keeping his promise not to 'circumvent' state medical marijuana laws and to highlight the unprecedented attack on patients and their providers across the country”. The week of action began on Monday the 13th, when hundreds of citizens called the White House telling Obama to keep his promise to 'not use Justice Department resources to try and circumvent state laws', demand he stop putting politics before science, and urging swift action to reclassify cannabis immediately.

On Tuesday, the public was urged to call their members of Congress demanding sponsorship of legislation to reclassify cannabis, end federal interference in state programs, and provide licensed patients and providers a defense in court.

Wednesday, saw a call for State Governors to sign on to the DEA Rescheduling Petition, with Thursday being a day of direct action with rallies at federal courthouses held in nine cities across six states.

The San Diego Rally for Safe Access organized by the San Diego chapter of ASA, was held at the San Diego Federal Courthouse on the corner of Front St. and Broadway. At noon, several dozen protesters converged on to the steps of the courthouse, told their stories, and chanted; “What do we want? Safe Access! When do we want it? Now!” along with “DEA Go Away, DEA Go Away”.


The stories included patients discussing their medical conditions and how cannabis helped improve their quality of life, as well as how the recent federal assault against them has impacted their ability to obtain the medicine that helps them.

Marcus Boyd, Vice Chair of San Diego ASA while on the bullhorn said, “In Obama's first term, we've seen over 200 SWAT-style raids on medical marijuana patients, dispensaries and growers. This is more raids in four years, then we saw during President George W. Bush's eight. This assault on patient's rights must end the Obama administration must uphold its campaign promises.”

From the Federal Courthouse, where Department of Justice attack dog U.S. Attorney Laura Duffy reigns, the protesters marched to the Hall of Justice, where San Diego District Attorney Bonnie Dumanis wages her war against cannabis patients in State court. At the steps of what looks like a great white fortress and serves as Dumanis' office, the group loudly voiced opposition to her prosecutions of legitimate medical marijuana patients as well as her recent bid for mayor. Protesters vowed to hold Dumanis accountable for her actions both at the ballot box as well as through opposition campaigns.

On the way back to the Federal courthouse the group stopped by the State courthouse and engaged in a little jury education, informing jurors waiting in line to get into the courthouse, that they cannot be punished for their verdicts and should examine not only the facts of the cases they are assigned to, but the law itself.

MMJ Week in San Diego - Chapter Meeting and Rally for Safe Access


Today is the start of Medical Marijuana Week!  Americans for Safe Access has created a week of actions our community must participate in to save safe access across the country.

Today's target is Obama!  Despite his indication to take a more reasonable approach to medical cannabis, President Obama and his Administration have become more aggressive towards our community.  In addition to raids, the Obama Administration has launched a variety of new tactics including patient privacy violations, seizing and shutting down of medical cannabis related bank accounts, manipulation of the tax code, threats to government officials and landlords, and interfering with medical cannabis patients’ Right to Bear Arms.  To read more about Obama’s mistreatment of our community, click here.

Bonnie Dumanis Anti-Medical Cannabis Campaign Continues

Medical marijuana patient in unambiguous compliance with state law, faces second prosecution attempt by San Diego District Attorney Bonnie Dumanis.

In the summer of 2009, Benjamin Gasper, along with two other seriously ill medical marijuana patients rented a warehouse space in the Sports Arena area of San Diego, a heavily commercial district far from residences and other “sensitive uses,” and began to collectively cultivate medical marijuana for personal medical needs.

All three members of the collective, as court documents have shown, signed an agreement in which they entered into a contract to “associate collectively or cooperatively to cultivate marijuana for medical purposes.”

The agreement went as far as stating that “all members of our medical marijuana collective will contribute labor, funds, or materials, and all will receive medicine.”

In later court proceedings both patient members of the collective cultivation effort testified that they did in fact contribute funds, materials, and their labor to the effort.
