ASA legal seminar in San Diego on Friday March 30
Americans for Safe Access (ASA) Chief Counsel Joe Elford will be in San Diego on
Friday for a two-hour legal seminar to discuss important new appellate court
decisions on medical cannabis in California. These decisions may have a profound
impact on how patients get their medicine and on how attorneys defend them in
court. Mr. Elford will also be discussing ASA’s new federal
lawsuits.

Imperial Beach Medical Marijuana Signature Gathering Effort Begins
Advocates begin circulating petition to overturn city’s ban on safe access to medical marijuana.
Imperial Beach, CA – On Friday, a team of community activists converged on Imperial Beach, began circulating a petition and gathering signatures to place the Safe Access Ordinance of Imperial Beach (IB) on the November 2012, ballot.
If passed, the measure would overturn the City’s current ban on safe access to medical marijuana and replace it with reasonable zoning regulations and operational requirements for medical cannabis dispensing collectives and cooperatives wishing to operate in the City.
The Imperial Beach City Council began working on this issue two years ago when Marcus Boyd, the Vice Chair of San Diego Americans for Safe Access and local business owner in Imperial Beach, brought the issue to them at a council meeting.
At that time, the city denied Mr. Boyd’s request for a business license and adopted a temporary moratorium, promising to conduct research and return a reasonable ordinance in just a few months. Two years, later instead of adopting an ordinance that allows safe access, the city approved an outright ban.
In weeks leading up to the vote, the Imperial Beach Patch conducted an analysis of crime in and around the area of existing dispensaries in South San Diego, and found that there was no increase, rather a decrease in crime. In addition, hundreds of letters signed by Imperial Beach residents were sent to the council urging them to adopt sensible regulations instead of ban and dozens of patients and citizens came out and voiced their opposition directly to the Council members at their meetings. Still the council voted to ban.
One of the more notable advocates for patient’s rights to voice opposition to the ban was Congressman Brian Billbray’s daughter, cancer survivor, and medical cannabis patient Brianna Bilbray.
After years of lobbying, writing letters, and attending city council meetings, the community was left with no choice but to take their plea to the voters.
The Safe Access Ordinance of Imperial Beach, a collaborative effort between Canvass for a Cause, Americans for Safe Access, and concerned citizens in Imperial Beach, was filed with the City Clerk’s office on March 5th. Within 15 days as required by state law the Clerk returned a ‘Title and Summary’ prepared by the Imperial Beach City Attorney, of the proposed measure.
Even though the California Election code requires the City Attorney give a true and impartial statement, not likely to create prejudice for or against the proposed measure the summary written by the Imperial Beach City Attorney was anything but true and impartial. In line with their tactics of doing all they can to derail safe access efforts in the city the summary was a clear attempt to misrepresent and misinform the voters reading it.
Although the law does allow for a legal challenge to be introduced against the wording provided by the city in the form of a ‘Writ of Mandate’, the decision was made to move forward with the signature gathering effort and avoid costly and lengthy litigation in order not to delay gathering the signatures any further.
On Thursday March 22, to satisfy yet another legal requirement, the ‘Title and Summary’ along with the text of the entire initiative was published in the Imperial Beach Eagle and Times, allowing the signature effort to legally commence.
To place the measure on the ballot a little over 1,000 valid signatures are required. The campaign’s goal however, is to gather at least 2,000 valid signatures, to ensure there are enough to qualify.
On Friday of last week, the first day of circulation, activists collected over 70 signatures in less then three hours. Although rainy and cold, Saturday and Sunday still saw several signature gatherers spread out through the City talking to voters. The effort will continue daily until at least 2,000 signatures are gathered.
To keep track and provide accurate reporting on the funds raised and expenditures incurred in support of the ordinance, the ‘Support Safe Access to Medical Marijuana Ordinance of Imperial Beach, Sponsored by Canvass for a Cause, with help from Americans for Safe Access and its local chapters,’ Political Action Committee (PAC) was organized.
“Legitimate patients deserve safe and reasonable access to their medicine. Right now, HIV/AIDS and other seriously ill patients are being criminalized for use of their medicine as a direct result of local government officials”, said Rachel Scoma, Co-Executive Director of Canvass for a Cause and Treasurer of the new PAC. “We need to ensure that seriously ill residents in Imperial Beach can obtain and use cannabis for medical purposes in accordance with California law”.

Volunteer Saturdays, Legal Seminar and Other Medical Marijuana Events this Month
The fight for safe access and patient’s rights
throughout San Diego
County is in full swing
and we need your help!
This month in partnership with Canvass for a Cause
our chapter has launched the signature gathering effort in Imperial Beach to place the Safe Access
Ordinance of Imperial Beach on the City’s ballot in November 2012. If passed
the initiative would overturn the city’s current ban on safe access and replace
it with reasonable regulations and zoning restrictions for collectives and
cooperatives wishing to operate in Imperial
Beach.
Today, there will be a weekly volunteer meeting in Imperial Beach at the
campaign headquarters (1233 Palm
Ave) at 2pm, where we will be providing signature
gathering and voter registration training. Anyone interested in volunteering to
gather signatures in Imperial Beach,
should attend this training! After the training, we will be going throughout
the city to gather signatures!

Working for Reform in Imperial Beach
To put the needs of sick and dying patients ahead of politics in Imperial Beach, we need people committed to reform in our local community.
Medical marijuana is an important local compassionate use issue, an issue that local officials have attempted to govern using a ridiculous, county sponsored, 'Smear with Fear' and 'Reefer Madness' campaign. Instead of listening to the community’s outcry for compassion and consideration for the health, safety and welfare of the city's most vulnerable residents, the City has banned safe access to medical marijuana in Imperial Beach.
During the two year long, local political process that led up to the ban, we witnessed local politicians relying on misinformation and personal prejudices to deny local residents safe access to medical marijuana. They used our local zoning laws to ban patients from associating in Imperial Beach, a right patients are entitled to by the Compassionate Use Act of 1996. In addition, the City Council offered a deaf ear to the Civil Grand Jury recommendations which called for reasonable regulations as well as the overwhelming community input in support of safe access on this issue.

March Meeting Update and Chapter News

San Diego ASA Members and Friends,
Thank you
to everyone who came out to the March 2012 San Diego ASA chapter meeting last
night at the La Jolla Brew House. The meeting was a tremendous success!
Last night
we discussed the latest news from ASA national, heard from attorney Lance
Rogers who provided updates about state wide litigation effecting patients’
rights, Canna Chef Kim gave a lesson on making canna butter, Larry Sweet
discussed the difference between cultivating with cannabis seeds vs. clones, James
Stacy provided an update on his federal case and Marcus Boyd discussed our
Imperial Beach Americans for Safe Access efforts.
In addition
last night, we heard from Hal Pilotte a medical marijuana patient facing
federal prosecution in San Diego
whose case will be moving forward in the coming weeks and who needs our support.
At last
night’s meeting we collectively raised over $100 dollars in donations for the
chapter as well as had a special guest stop by; Brian Pease, a local freedom
fighter attorney, animal rights activist, and supporter of medical marijuana
patients’ rights running for San Diego City Council District 1 against incumbent

Civilizations throughout the world have realized the

Legal Seminar: Navigating Safe Access to Medical Marijuana through the California State and Federal Courts
Last year, California appellate courts ruled in Pack v. City of Long Beach and City of Riverside v. Inland Empire Patient's Health and Wellness Center, considerably altering the legal landscape of safe access to medical marijuana. In January, after urging from ASA and other groups, the California Supreme Court decided to review these harmful rulings, thereby decertifying them. Since then, however, two more appellate court ruling were issued last month: People v. Colvin and City of Lake Forest v. Evergreen Holistic Collective. These, fortunately, are far better rulings for the medical marijuana community.

Imperial Beach Initiative Would Regulate Dispensaries and Repeal City’s Ban

Medical marijuana advocates unveiled a proposed ballot
measure this week for the City of Imperial
Beach that would create zoning and operational
standards for medical cannabis dispensing collectives and cooperatives.
The move came after the IB City
Council passed a dispensary ban last year, and amid Justice Department raids
and threats against landlords and public officials, which have resulted in over
200 facilities closing their doors throughout the County in less then 4 months.
For years, patients and
advocates in Imperial Beach attended City Council meetings, wrote letters, and made
phone calls asking for compassion and respect for state law. Instead of listening
to their constituents and the will of California
voters, IB City Council approved the most egregious ban in the County in July
of last year.
The ban prohibits any facility
where more then three medical marijuana patients meet or congregate collectively
and cooperatively to cultivate or distribute marijuana for medical purposes,
from operating anywhere within city, even in the privacy of their own home, in
direct opposition to what state law authorized.
“The citizens of Imperial Beach deserve
safe, reasonable, and reliable access in their neighborhood. The unconstitutional
ban has forced hundreds of sick and dying patients to travel long distances to
obtain their medicine and has completely frustrated the purpose and intent of Prop
215 which voters in IB passed with overwhelming support in 1996,” said Marcus
Boyd Vice-Chair of San Diego ASA. “This measure will give us an opportunity to
ask the voters again whether they support safe access to medical marijuana for
qualified patients and if approved, will create a means for patients to safely
obtain their medicine in the City.”
Within fifteen days of filing,
the City is required to provide a ballot title and summary for the proposed
measure which will be printed in the ‘Eagle and Times of Imperial Beach’ a
local circulating newspaper. After the printing, advocates will begin the
signature gathering process.
Once all the required
signatures are gathered, they will be submitted to the County Registrar
of Voters for verification. After verification, the City Council will have an
opportunity to consider the ordinance and can adopt it as law rather then spending
the money to send it to the ballot.
